筆戳獄友眼睛 受刑人判刑1年5月
新聞描述: （中央社記者蕭博文台北24日電）一名在台北監獄服刑的陳姓男子，不滿同房的張姓獄友指責他占用廁所，持原子筆朝張男眼睛戳去，但僅戳中眉毛。高院日前依重傷害未遂罪，判處陳男1年5月徒刑，可上訴。
台灣高等法院公布的判決書指出，陳姓男子因殺人未遂罪於台北監獄服刑，與張姓男子為同房獄友，平日交情不錯。
民國105年5月10日晚間，陳姓男子不滿張姓男子不斷制止他說話，還指責他占用廁所太久，按報告鈴請求調房。
由於獄方遲未處理，陳姓男子一時氣憤，持原子筆走到張姓男子背後，右手扳起張男頭部，左手持原子筆朝張男眼睛方向戳擊，但只戳到張男右眉，且因用力過猛，原子筆當場碎裂。
張姓男子遇襲後以手遮臉倒地掙扎，陳姓男子不顧其他獄友阻擋，又持保溫杯毆打張男，直到監所管理員到場才住手。張男因此有兩眼結膜下出血、右臉挫傷等傷勢。
高院承審合議庭認為，眼睛是人體重要且脆弱的器官，陳姓男子持原子筆朝張姓男子眼部戳擊，具有重傷害故意，但未造成重傷害的結果，應論處重傷害未遂罪。
合議庭考量，陳姓男子與其他受刑人同處一室，因空間狹窄難免爭執，生活壓力不是一般未受監禁者可相比。案發前陳男即對張姓男子有所不滿，但並未立即暴力相向，而是在通報獄方未獲即時處置後才施暴洩憤。
合議庭也審酌，張姓男子表明撤告，若處以陳姓男子重傷害未遂罪的最輕刑度2年6月，有情輕法重的失衡狀況，依犯罪情狀情堪憫恕減輕其刑，判刑1年5月。（編輯：方沛清）1070324
